The Minimum Energy Efficiency Standards, or MEES, is new legislation which will become law on 1st April 2018. In basic terms, it means that all properties which have an energy rating of below an E on an EPC would not be able to start a new tenancy. Homescore are able to provide a MEES Report for landlords, which will identify what improvements can be made in order to raise an F or G rated property to an E or above. We can also identify what funding streams are available for landlords to access to finance the works - the rules of the MEES legislation state that improvements must be cost-neutral for the landlord.

Landlords of residential accommodation have a legal duty under Health & Safety legislation to assess the risk of Legionella within a property and introduce control measures to minimise any risk.

Everyone who lets residential property - having an LRA is a legal requirement under the L8 Approved Code of Practice (ACOP), published by the Health and Safety Executive in 2001 and still in force today. The ACOP requires a landlord to "...assess the risks from exposure to Legionella to their tenants. An Energy Performance Certificate, or EPC, is a rating given to a property to give the homeowner, as well as potential buyers and tenants, an indication of its energy efficiency. The ratings are alphabetical, starting with an ‘A’ for the most energy efficient homes, dropping to the bottom rating of ‘G’ for the worst performing homes. The EPC will also give the homeowner guidelines (including estimates of cost) on how to improve the energy efficiency of their home.

A valid EPC is required when the property is marketed for either sale or rental. The certificate is valid for ten years – you can check to see if a property has an EPC by going to the online register at https://www.epcregister.com/home.html and inputting your details. It is very important to have an EPC in place when advertising a home for sale or let, as you can be fined for marketing a property without a valid EPC.

An inventory is a detailed report showing the condition and contents of a residential property – usually one that is being rented out. Inventories are used for both furnished and unfurnished properties. It is important for the inventory to be thorough and use pictures and/or video to record the exact condition of the property and its contents. The inventory will form part of the contract between the tenant and landlord, and is an essential document when it comes to deposit disputes. An inventory should be completed pre check in and / or pre check out stage to record the condition of the property (and its contents) at the start and end of a tenancy.

We strongly advise that a comprehensive inventory is a core part of any tenancy agreement. It is there to protect the both the landlord and tenant in case of dispute. Whilst an inventory is not a statutory requirement, a protected tenancy deposit scheme is – and those schemes rely on a comprehensive inventory being in place when it comes to deposit disputes. It is common for a tenant to claim that the damage already existed when the tenancy started. Unless you have proof of the state of the furniture/property at the beginning in the form of a properly prepared and agreed inventory you are unlikely to succeed when a dispute occurs.
